USFWS plans to divest responsibilities at Bear Butte

POST OPEN HOUSE- MEETING OF PHAS FOR ADDITIONAL DISCUSSION
Also Prairie Hills Audubon Society (PHAS) has rented the meeting room at the Sturgis Agricultural Extension Bldg for a post open house discussion on this plan, and/or any other Bear Butte or local wildlife related concerns. After the USFWS terminates their meeting we will relocate a few blocks to the South to the Ag Extension Building which is just west across the parking lot from the Meade County Court House.

Geography & History of Bear Butte Mountain Lake
On the east of Highway 79 is the Bear Butte Mountain, which is a laccolith geologic formation up- thrusting from the plains. The Mountain is owned by the State of SD (as a Park), various Native American Tribes and private land owners. On the west side of Highway 79 is Bear Butte Lake, which sits in one of the drainages coming off of Bear Butte, which drainage is a tributary of Spring Creek. Spring Creek flows around the north side of Butte and joins Bear Butte Creek about 6 miles east of the Mountain. The Lake was once a natural lake or a prairie pot hole. A dam was built along its south west side and the natural lake/pot hole is now augmented with additional surface water runoff now collected by the dam. Also there once was an artesian well near Bear Butte, which was used to supply additional water to the Lake, and the USFWS had an easement to pipe water to the Lake. The engineering on this well failed in 1987, was not fixed and thus this ground water no longer augments the surface water. The Lake supports an artificial fishery of introduced fish, which periodically die off when the lake shrinks and the low oxygen/high temperatures kill the fish. It provides for shore birds and waterfowl and is especially important habitat for them during the spring and fall migrations. Upland areas provide mixed grass prairie habitat. Right now due to drought the Lake is very low.
The Lake is both a State Park and a National Wildlife Refuge (NWR). Thus both the United States Fish and Wildlife Service (USFWS) and SD Game Fish and Parks Department (SDGFP) have a say in how the Lake Refuge/Park is managed. It is operated under a cooperative agreement executed in 1967 between the USFWS and SDGFP, allowing for SDGFP to manage the Refuge/Park pursuant to the USFWS rights. .
The Refuge was created in the late 30s when the USFWS acquired conservation easements from the State of SD, the War Dept. (now - Bureau of Land Management - BLM) and private landowners. The conservation easement was to maintain an area for "migratory bird, wildlife conservation and other purposes". The 1935 executive order states the purpose of refuges are "as a refuge and breeding ground for migratory birds and other wildlife..."
As part of the purpose of the refuge the easement reads:
Most of the Dam is on land owned by the BLM and some of the Dam is on land owned by the State. The BLM's land is to the western side. There are 3 small parcels within the Refuge Boundaries, along its edges were the land is owned by private persons.
Proposal to divest themselves of the Refuge.
The USFWS believes that the SDGFP via its promotion of the recreation uses of boating, swimming, camping and picnicking at the Lake, prioritizes recreational use over wildlife. It believes that the recreation use hurts the wildlife. The USFWS mission is to protect wildlife; it allows for recreation related to wildlife on its refuges but when conflicts arise, wildlife, not recreation is the USFWS priority. For example they believe that the recreational uses at the Lake, prevents whooping cranes, a endangered or threatened species from using the area. They don't think a park managed for recreation should be a refuge and want to walk away from the Bear Butte NWR, giving up their easements.
They have a planning document called an Environmental Assessment (EA) and propose only two alternatives; to continue the status quo or to divest themselves of the Refuge.
We (Prairie Hills Audubon Society) strongly objects to this plan. We will provide some reasons below.

REASONS TO OBJECT TO THIS PLAN:
1. INSUFFICIENT ALTERNATIVES -- The USFWS only proposes two alternatives, it should have proposed another -- alternative in which USFWS insists that the State change its management of the Lake and the Lake's surroundings to decrease the impacts of recreation to wildlife. For example the USFWS could prohibit boating all together or prohibit boating at key times, such as spring and fall. We believe that an alternative which reduces the conflicts should be created and be the preferred alternative.
2. INSUFFICIENT DOCUMENTATION OF CONFLICTS -- Birders who use the Refuge, don't see that much use by recreators during the key migration times. The USFWS has provided us with data on the Parks infa-structure and policies but has not provided data on the Parks actual patterns of recreation use or actual wildlife data except to list species that occur there. Thus it does not backup its allegations the conflicts actually exist. For example the EA says "Documentation of bird occurrence and use is not well-developed for this refuge." But ironically they know that recreation is adversely impacting wildlife!
3. NATIVE AMERICAN CULTURAL PROTECTIONS UNDER FEDERAL LAWS BEST - The Federal government has very superior laws about consultation with Native Americans, about environmental justice, and about protection of historic/cultural resources than does the state. Native American interests may suffer with the removal of the USFWS from the area.
4. NEPA PROTECTIONS - When the federal government plans a project, gives money for a project or permits a project, NEPA (The National Environmental Policy Act) is invoked. If the area affected has "Unique characteristics of the geographic area such as proximity to historic or cultural resources, park lands, prime farmlands, wetlands, wild and scenic rivers or ecologically critical areas." an Environmental Impact Statement (EIS) is needed. ( 40 CFR 1508.27 (b) (3)) An EIS is a superior planning process to an Environmental Assessment (EA). One can ask why isn't an EIS on this Bear Butte NWR divestment plan of the USFWS being done?
Some of the future development in the area may involve federal dollars/plans. The state of SD is planning to build a by-pass around Sturgis to drop traffic from I-90 on the east side of Sturgis. Some suspect the recent flurry of commercial rally related development near Bear Butte is in anticipation of this new by-pass. With a Wildlife Refuge in addition to a National Historic Landmark, on Highway 79, there are better arguments for an EIS not an EA on the proposed by-pass or other future projects, which may involve federal dollars.
5. INCREASING THE PUBLIC LAND "FOOT PRINT" AT BEAR BUTTE -
Inappropriate development threatens Bear Butte. The Mountain itself is very special. The grasslands which surround it have some wetlands, wooded draws and riparian areas, with several streams running parallel to each other and merging in the area. Part of the Mountain itself and most of lands immediately under the slope of the mountain remain in private ownership. Meade County has no zoning. Private land in the area is getting very expensive, it is possible that the tribes don't have the financial resources to purchase all the needed lands, to secure both the Mountain and a buffer immediately around it..
Many believe purchase of land or conservation easements for public and/or tribal ownership is needed. Currently BLM, USFWS and the BIA (holding land in trust for tribes) are the federal land owning agencies in the area. There are federal conservation related monies sources for both BLM, USFWS to purchase land or easements (Land & Water Conservation Fund) and perhaps the BIA could be used, in a precedent settling manner, to receive federal conservation funds. There are federal tax breaks to donate conservation easements. We hope that in the future the USFWS can acquire more land or conservation easements in the area. Wouldn't a large prairie wildlife refuge including the grasslands and streams surrounding Bear Butte be great -- wouldn't a large buffalo herd (not bikers or subdivisions) surrounding Bear Butte be great? If USFWS leaves we will be left with the BLM, which is a "multiple-use" agency and as PHAS is a wildlife-biodiversity oriented group, we prefer the USFWS over the BLM as a federal land manager in this area.
TRIBES and LWCF FUNDS
The BIA has no precedent of which we are aware, to receiving LWCF conservation related funds, but maybe new precedent can be set at Bear Butte. Also sometimes the Federal government provides LWCF conservation grants programs requiring matching dollars for States/local government to purchase lands,/easements. But such grant programs did not receive any budget allocations in this fiscal year. I believe tribes can apply and compete within the State grant program for matching funds, in years when this state grant program is funded. Options of LWCF funding is something tribes could investigate.

Rumor has it that more than 300 women will be converging on the Capitol on Thursday. The buses are full, but carpooling is still possible. There is still money available to help support those that can carpool to the event. More information:

Dear Friends,
Each of you deserves a hand-written note, rather than an email blast thanking you for the generous party hosted last night by the Black Hills Dems, but I must admit that today I'm saving time with this mail. HOWEVER, don't assume that emailing has less heart---it doesn't. In fact, your finding time to stop by, to stay late, to give a card, to write a note, to call,to take time from your busy schedules to greet me warmed my heart and touched me very much.
A lot of effort went into the planning, the writing, and the thoughtful honoring of me and my Bill. The gift is just lovely--I have a couple special spots for it in mind. It is now gracing my living room and it's a great look! I'm just amazed at the Scrapbook and the immense effort it has taken to assemble. The letters will be treasured---and I know also that those things do not just "happen." Your efforts have touched me and with your permission I'll hang on to the kind words for encouragement, patience, and energy as we continue to build our party for all the right reasons!!
Thank you for honoring Bill Walsh, my dear friend who is indeed a leader of Democrats. Bill and Jo will continue to impact our party in every positive way. They are the faces of true Democrats---our source of pride!!
I don't have email addresses for everyone so please pass this on to individuals and share at your respective meetings as well. Welcome Meade County! During and after the 2006 election cycle, many of us worked hard to identify important ways for us to have an even better 2008 election. As a result, the Pennington County Democrats are organizing several committees to work on these ideas and turn them into reality. The work we do now is critical to our continued progress in 2008 and beyond.
All committees are kicking-off at the Labor Temple starting this Saturday. Only one committee will meet on the 6th; three committees will meet on both the 13th and 20th. At these organizational meetings, the committees will choose co-chairs and set goals for the committee. Each committee will develop its own meeting schedule for the future and report back at the monthly Pennington County Democratic meeting.
Please choose one (or two) committees that match your interest and ability and come help make it happen! The organizing meetings will be held as follows:

4. Friday Forum Returns, Jan 5
The Friday Forum will continue in 2007! The first Forum for the year will be on January 5 at 4 pm at the Rapid City Public Library. The topic wll be: Western Dakota Technical Institute and the Voc-Tech system in South Dakota. This year, the Legislature is considering putting WDTI under the umbrella of the University System, instead of local school districts. The speaker will be Dr. Rich Gross.

County Democrats Support Care and Share Food Drive
Rapid City, SD ? Dec 6, 2006 ? The Pennington County Democratic Party is using some its post-election enthusiasm to help the needy of our region by supporting the KOTA Care and Share Food Drive.
The group's post-election meetings and planning for the upcoming Christmas holiday party on December 10 all have included collection of food and funds for the Food Drive, and Party members are being encouraged to support Food Drive events as much as they can this holiday season. In addition to collecting food and donations at events, the Pennington County Democrats are also sponsoring a KOTA Care & Share collection site at Rapid Care in Rapid City.
It's possible that the seed was planted by a chili feed held by U.S. Rep. Stephanie Herseth at the Billion Headquarters the Friday before the Nov 7 election. Rep. Herseth donated the food, but all attendees were asked to contribute to a collection for the Cornerstone Rescue mission.
The idea of joining KOTA Care And Share was first floated by Democratic Party activist Karen Hall, who said, "joining the Food Drive just made sense, as an opportunity to share our Democratic values, encouraging all to support those in society that truly need our help."
Curtis Price, who handles electronic communications for the group, said, "the 2004 election cycle was a real watershed for Democrats in West River. We have identified many new supporters and new lines of communication, through many personal contacts, a highly expanded presence on the Web. We figured it would be a great opportunity to use our network of committed folks to support the KOTA Care and Share Food Drive. We want people to know that although we are political people and like to talk about ideas, in the end we're in it to help influence government to do the right thing. It's really about our values."

The PenDems had a very successful meeting on Thursday, Nov 16. Almost sixty committed Democrats were there, and the course was set for the next few months. Sarge Preston was elected State Committeeman from a field of five motivated and energized candidates. Traditional news organizations, although many do great reporting, sometimes have their content and delivery modified to get higher ratings, or better serve the needs of corporate stockholders. Even news from public broadcasting isn't always unbiased--for example, the entire board of directors of the Corporation for Public Broadcasting, which is a major funder of public broadcasting, must be approved by Congress? Check out Democracy Now! -- it is totally funded by listeners and viewers.

PenDems Meet!
The Pennington County Democratic Party meets on Nov. 16. This is more than a Party. It's a movement.What a great meeting on Thursday night. To start it off, when folks showed up they brought food to donate to the KOTA Care and Share Food Drive, filling up the back of a pickup truck for those in need. And, there were 55 people there. The energy in the room was so positive... we are thinking about 2008 already, but we are also thinking about 2006. Eric Abrahamson has urged us to leave this election energized to serve our community with renewed commitment outside of party politics, to continue to put our ideals into action in everything we do. We have many opportunities for public service, and Dems should be in there sharing our values, doing what we always do, so people know what what our values are long before there's an election going on.
As we turn the page from this exciting campaign season, we see new ideas and new leadership that honors and builds on the sacrifices and efforts of the past. The mood is very positive. (Having both of our most senior representatives to Washington now in the majority party is helping the mood too, of course!)
After careful consideration and voting among a field of five excellent candidates, Robert "Sarge" Preston was elected to fill Haven Stuck's seat as State Committeeman until April and will represent us, along with the rest of the Executive Board, at the State Party meeting on December 9 in Chamberlain. At that meeting no fewer than four very strong candidates will be running for SD Dem Party chair.
Linda Lea Viken, a long time observer and former State Legislator, explained to the group that after the election the balance in Pierre is far improved over last year. In 2007, moderate Democrats and Republicans will have much more representation on committees, and in the State Senate, Republicans will need the Dems help to pass any specific appropriations--as these require a 2/3 "super-majority," and the Repubs can't do it alone any more. The group discussed how having Tom Katus at the table in Pierre, and at the West River cracker barrels, will help us bring our values forward. Our hard work in 2006 has created change, and there WILL be dialogue this year!
Eric Abrahamson, Lois Facer and Ritchie Nordstrom reported that they have been up in Meade County helping Mary Beth Anderson, the new Party Chair up there, get organized, so now we have a more active Dem organization up there.
We heard about other activity that bodes well for our future: Justin Lena our chair, committed himself to continue to serve our Party after his term ends in April. Jocie Baker is working on a pilot voter identification project using information we developed during the election which we can use as a template for similar efforts throughout the County. Lesley Kandaras, Cheryl Chapman and others are development a strategy document based on the results of our highly successful post-election information-sharing session last Saturday. The room was bubbling with many people with lots of ideas, but with a lot of focus and commitment to improving life in West River and South Dakota to better align with the values that our Party represents.
